Overview

In case someone has lost/burnt/stolen/misplaced his or her Certificate /Lease, he or she shall approach the Land Board for replacement.

Plot Inheritance

Overview

Inheritance is the process of obtaining land rights (property) from someone who is no longer alive. This applies to land allocated by both Landboard and Chiefs.

Who is eligible?
  • Motswana
  • Persons so designated by the will
  • As agreed between the siblings and verified by bogosi
  • Attained age of majority
How do I get this service?
  • Letter from Bogosi confirming inheritance
  • Resolution from beneficiaries indicating heir / will
  • Letter from the heir accepting the inheritance
  • Completion of APPLICATION FOR TRANSFER OF LAND RIGHTS form
What supporting documents are required?
  • Certified copy of Omang/ID (heir, beneficiaries or witnesses)
  • Copy of death certificate of previous owner
  • Copy of marriage certificate (if not married Affidavit confirming marital status for business plots)
  • Copy of Instrument signed under Married Persons Property Act (Marriage In/Out of community of property)
  • Original Copy of the certificate of the late owner
  • In case of plots that predate the land board, a letter from Bogosi confirming allocation
  • Letter from Bogosi confirming inheritance
  • Resolution from beneficiaries indicating heir / will
  • Letter from the heir accepting the inheritance

Conversion from Customary to Common Law

Overview

Once granted land under customary grant, there is provision to convert such to common law grant. The grantee will be issued with a legal agreement of lease to confirm their right of occupancy for a specific period of time.  The length of the lease is 99 years.

To apply for a Memorandum of Agreement of Lease follow the steps below:

  • Copy of Marriage Certificate (if applicable)
  • Copy of Instrument signed under Married Persons Property Act (proof of Marriage regime if married and Affidavit if not married)
  • Certified copy of National Identification card (Omang)
  • Original (Customary) Plot Certificate

Application for Common Land Law Rights

Overview

Applications under this category are for business ventures. Plot holders on tribal land are issued with a lease agreement for a specified period of time.  This Memorandum of Agreement of Lease is a legally binding contract entered into between the Land Board (lessor) and the plot holder (lessee).  The lessee is expected to comply with the lease requirements amongst which is payment of annual lease rentals except for residential purposes which is a once off payment.

A Memorandum of Agreement of Lease may be issued for, but is not limited to, the following purposes:

  • Mining activities
  • Agricultural activities
  • Industrial activities
  • Commercial activities
  • Tourism
  • Civic and communities
  • Residential for non-citizens
  • Residential for citizens
  • Wildlife and birds sanctuaries

  • Proof of financial assistance from the Poverty alleviation scheme Certified and valid copy of Omang
  • Copy of Instrument signed under Married Persons Property Act (proof of Marriage regime if married and Affidavit if not married)
  •  Decree absolute and court order where applicable
  • In case of widow/widower, death certificate
  • In case of People Living with disability (PLWD) copy of Disability Card
  • In case of dis-advantaged and marginalized groups, a confirmation letter and assessment report from District Council
  • Share certificate

Once plots are available, they are advertised to the general public. Interested persons can respond to the advertisement.

Application for Customary Law Land Grant

Overview

It is an application for Grant of Customary Rights on Tribal Land.  Upon allocation, the plot holder shall be issued with a Deed of Customary Land Grant printed on a paper with special security features. Once granted, the Rights are held in perpetuity and can be passed from one generation to another.

A customary law land grant can be issued for, but not limited to, the following purposes:

  • Residential plots
  • Arable fields/integrated
  • Borehole

Sales of Maps

Overview

The Department produces both land use maps and development proposal maps. Land use maps details the different land uses within a particular place/location (what developments are currently there). Development proposal maps details the different land uses within an area and the different development proposals (What development are currently there in area and what developments are planned for the future).

Sectoral department, general public and Local Authorities.

How do I get this service?

Paying a visit to the Department of Town and Country Planning.
