Provision of Voters Roll

Overview

The voters roll, which lists by constituency, polling district and polling station, the name, sex, address, national identity card number and voters’ registration card number of every voter, may be accessed by political parties, independent candidates and members of the public, as per the Electoral Act: 21 of 2008, s. 5. (3). Any person may, upon payment of a fee prescribed by the Secretary from time to time, make hard copies of a roll or take extracts there from during the hours aforesaid.

Who is eligible?

Registered political parties, independent candidates and members of the public are eligible to receive a copy of the voters roll.

How do I get this service?
  • After publication of the voters roll, any stakeholder may request a copy of the roll or a specific section of the roll at a fee prescribed by the Commission. The request for the rolls can be made at the IEC contact information noted below.
  • Stakeholders will be notified by a public notice in the Government Gazette when the rolls are ready and where they could be accessed.

How long will this service take?

Within 10 minutes of your application request if made in person at IEC offices. Requests by post can be expected in two to three weeks.

  • Political parties and independent candidates may obtain a copy of the roll at no cost.
  • Members of the public will be charged a nominal fee of prescribed by the Independent Electoral Commission, which is adjusted on an annual basis.

Objection to Voter During Poll

Overview

A candidate, polling agent or voter may object to another voter at the polls on the following grounds:

  • They believe the voter is not the voter named on the Voter Registration Card;
  • They believe the voter has voted before in the same election; or
  • They believe that the voter is disqualified from voting in the election.
Who is eligible?

Citizens of Botswana, 18 years or above who hold a valid voters’ registration card.

How do I get this service?
  • Complete Form Q (Objection to Voter) before a presiding election officer at the poll. This declaration is made under oath.
  • If the voter does not respond to the objection by making a written declaration using Form R, the presiding election officer will either:
    1. Not issue a ballot to that person.
    2. If a ballot was already issued, but the voter has not yet entered the polling booth, the officer will impound and cancel the ballot paper.
    3. If a ballot was already issued and the voter has already cast the ballot, the presiding elections officer will make a notation on the election roll sating, "protested against under section 57".

Objection to Voter by a Voter

Overview

Any person whose name is included in a voters roll for any constituency may object to the inclusion of any other person in a voters roll for that same constituency.

Who is eligible?

Citizens of Botswana, eighteen (18) years or above who hold a valid voters’ registration card for the same constituency as the voter he/she is making an objection about.

How do I get this service?

Same process as an appeal:

  • Complete Notice of Objection to a Voter by a Voter (Form G)
  • Within twenty one (21) days of the publication of a supplementary roll or forty two (42) days of the publication of a general roll, deliver the completed Form G together with a deposit of BWP 10.00 to the Principal Registration Officer for the appropriate constituency.
  • The Principal Registration Officer will arrange for the objection to be heard by a Magistrate and will notify you and the person you are objecting to of the date and location for the hearing. The Principal Registration Officer will also forward a copy of the objection to the person you are objecting about.
  • The decision of the Magistrate is final and cannot be appealed further.
  • If the objection is successful, the objector will be refunded the BWP 10.00 deposit.
  • Should the appeal not be successful, the BWP 10.00 deposit will not be refunded.

In addition, if the magistrate feels that the objection was made without reasonable cause, he may order the objector to pay to the person to whom the objection relates such sum not exceeding P500.

After delivery of the Notice of Objection to the Principal Registration Officer, it should take approximately two (2) weeks for the magistrate to hear the objection.

Nomination of Candidates for Elections

Overview

Upon the calling of a National Assembly or Local Government elections, any person wishing to run as a candidate in the election, must be nominated by nine (9) supporters. 

Who is eligible?

Candidates for National Assembly and Local Government elections must be:

  • Citizens of Botswana holding a valid National Identify Card (Omang),
  • Eighteen (18) years of age or above,
  • Valid voter registration card .

In addition, candidates for National Assembly must be able to read and write in English.

How do I get this service?

In order to be nominated for National Assembly and Local Government elections, potential candidates must complete the following steps:

  • After a Writ of Election (National Assembly) or Election Instrument (Local Government Election) stating the date and hours of nomination has been issued, prospective candidates should complete Form O – Nomination Paper, ensuring that it contains endorsements from at least nine supporters who are on the election roll for the electoral district for which the candidate wishes to seek election.
  • The candidate and his/her supporters should bring the completed Nomination Paper and supporting documents (listed below) to the Nomination Centre for their district. The location, date and hours within which candidates shall present their nomination papers will be included in the Writ of Election or the Election Instrument.
  • If any proposer, seconder or supporter is unable to sign their name, they affix their mark in place of signature and such mark is witnessed by a person who can sign his name; such witness in addition to their signature, writes their name clearly immediately under such signature.
  • The candidate pays a deposit:
    1. to any Government Revenue Office prior to presenting his/her Nomination Paper; or
    2. to the Returning Officer at the time of presenting the Nomination Papers.
  • If the deposit was made at a Government Revenue Office, the official receipt must be presented to the Returning Officer along with the Nomination Papers.
  • The Returning Officer will examine the Nomination Paper and supporting documents presented and will determine if they are valid. If they are deemed valid, the candidate will be considered nominated for the election.
  • If a candidate’s Nomination papers are ruled invalid, the candidate may submit a second Nomination Paper as long as it is submitted before the close of nominations.
  • A candidate may at any time before the close of nominations withdraw his candidature by giving written notice to the Returning Officer signed by himself/herself.

The process of verification of the Nomination Paper and supporting documentation should take approximately 5 minutes.

How much does it cost?

A cash deposit of BWP 500 for National Assembly elections or BWP 100 for Local Government elections is required. Deposits will be returned if:

  • The candidate dies before the date of the election;
  • The election is declared void;
  • The candidate withdraws his candidature before the close of nominations;
  • The candidate obtains 1/12 of the total number of votes cast in the election; or
  • The candidate’s nomination is invalid.

Declaration by Voter Objected to During Poll

Overview

A voter who has been objected to at the polls by a candidate/candidates’ representative or another voter through Form Q (objection to Voter), may retain their ballot by making a declaration under oath denying the accusations contained in the objection.

Who is eligible?

Citizens of Botswana 18 years and above who hold a valid voters’ registration card and have been objected to by a candidate/candidates’ representative or another voter are eligible for this service.

Appeal Against Rejection of Voter Registration

Overview

An applicant whose application to become a registered voter has been rejected by a registration officer may appeal to the Principal Registration Officer for the particular constituency.

Who is eligible?

Citizens of Botswana eighteen (18) years or above whose application to become a registered voter has been rejected by a registration officer can apply for this service.

How do I get this service?

In order to launch an appeal, follow the steps below:

  • Complete Form F - Appeal by Person whose Application to be registered as a voter is rejected by a registration officer.
  • Within seven days after the rejection of the application, deliver the completed Form F together with a deposit of BWP 10.00 to the Principal Registration Officer for the appropriate constituency.
  • The Principal Registration Officer will arrange for the appeal to be heard by a Magistrate and will notify the complainant of the date and location for the hearing. The decision of the Magistrate is final and cannot be appealed further.
  • If the appeal is successful, the voter will be registered as a complainant in the polling station named in your appeal.
    1. The complainant will receive a Voter’s Registration Card (Form B) on the next physical visit to a Registration Officer in your constituency.
    2. The complainant will receive a refund of the BWP 10.00 deposit.
  • Should the appeal not be successful, the BWP 10.00 deposit will not be refunded.  Complainants are notified by the contact information on their application regarding the status of their appeal.
