Industrial Court Rules Strike by Essential Workers Illegal

The Industrial Court has today (6/5/11) ruled that the public service strike with respect to all essential service employees is unlawful and unprotected.

In so doing the Court confirmed its original Interim Order, which was granted in favour of DPSM on behalf of Government on 26th April 2011.

The essential services covered by the Judgment of the Industrial Court are:

Electricity Services
Fire Services
Health Services
Sewerage Services
Water Services; and
Transport and Telecommunications services necessary to the operation of any of the forgoing services.

Therefore all essential service employees in the above areas, including support services, must remain at work. Any such workers who have not already returned to work must do so immediately. Failure to do so will risk summary dismissal.

The Industrial Court further confirmed its Interim Order of 23rd April 2011 interdicting DPSM on the use of replacement labour.
