Stealing by person employed in the public service
A 38 year old woman appeared before the Village Magistrate Court charged with one count of stealing by person employed in the public service contrary to section 271, as read with Section 276 Penal Code and one count of uttering a false document contrary to Section 348 of the Penal Code,(Cap 08:01),Laws of Botswana.
DCEC Investigations
Investigations conducted by the Directorate on Corruption and Economic Crime (DCEC) revealed that Tebo Tracy Moyo while employed by the Attorney General’s Chambers for seven years as the Principal State Counsel II therefore a Civil Servant in the Francistown Administrative District of the Republic of Botswana stole the sum of twenty-four thousand, hundred and six pula twenty thebe imprest which had come into her possession by virtue of her employment between 6th- 27th August 2004 and uttered false receipt, invoices purportedly issued by Cresta Lodge Gaborone and Chatters Restaurant as lodging and meal expenses to Tsholofelo L Moadimo, an Accounts Officer with Attorney General’s Chambers ,a representation which the accused knew to be false.
Convictions and Sentencing
The accused was convicted and sentenced to one year imprisonment, wholly suspended for three years on condition the she does not commit a similar offence on the first count and convicted and sentenced to six months imprisonment wholly suspended for eighteen months on condition the she does not commit a similar offense. Moyo was represented by Mr Lone Masire of Masire Mthimkhulu Attorneys while Jacqueline Both of DPP represented the state.
