Four people appeared before Broadhurst Magistrate Court charged with 12 counts of obtaining by false pretences contrary to Section 308 as read with Section 307 of the Penal Code (Cap 08:01), Laws of Botswana.
DCEC Investigations
Facts of the case have revealed that the accused persons, Olaotse Masisi, an Accountant at the Ministry of Education; Mogotsi Tadubana; Kinston Mmolawa, self employed; Brinnel MC'Lin Stock, account technician; Biki Boiketlo Letsididi, a teacher; Mogomotsi Molatlhegi and others not before court, between September and October 2009 in Gaborone, acting together and in concert, with intent to defraud, obtained from the Government of Botswana on different occasions an amount of sixty-nine thousand three hundred and twenty pula ( P69 320), by falsely pretending that Ngwenya Jabulani, Modise William, Kagiso Kalaetsile, Gobusamang Jorosi, Refilwe Mompati Selepeng, Opelo Semati, Gabriel Diteko, Onkokame Taredi and Brinnel Mc'Lin Stock were Government of Botswana sponsored students studying at Limkokwing University and Gaborone Institute of Professional Studies (GIPS) and claimed they were owed off-campus allowances for three months (October, November and December) by the Ministry of Education when in fact and in truth they knew that the said persons were not students for the said institutions, were not sponsored by the Government of Botswana and were not owed any outstanding allowance.
Trial and Sentencing
During trial Olaotse Masisi turned into accomplice witness while Mogomotsi Molatlhegi was acquitted. Mogotsi Tadubana was sentenced to 18 months imprisonment, 12 suspended; Kinston Mmolawa was sentenced to 3 years imprisonment, 2 suspended for 3 years; Brinnel Stock was sentenced to 3 years imprisonment wholly suspended while Biki Letsididi was given 18 months imprisonment wholly suspended.
