Damain Pheto
One count of conflict of interest
A 58 year old man, Damain Pheto appeared before Masunga Magistrate Court charged with one count of conflict of interest contrary to section 31 (1) of the Corruption and Economic Crime Act (Cap 08:05) Laws of Botswana.
DCEC Investigations
Investigations conducted by the Directorate on Corruption and Economic Crime (DCEC) revealed that Pheto, being a Public Officer working as Acting Head of Department and Engineering Services (DBES) in Masunga, on the 18th July 2008 at Masunga, in the North East Administrative District of the Republic of Botswana knowingly failed to disclose the nature of his interest in Convic Builders (Pty) Ltd to the board, a company in which his wife Constance Pheto and son Matthews Pheto were shareholders. Pheto chaired a meeting to evaluate certain quotations of which one was from Convic builders (Pty) Ltd for tendering to maintain six DA LA2 houses, six DA LA3 houses in Masunga, a DA LA2 house, a roundavel and a customary Court at Mapoka. Pheto is alleged to have influenced the approval of Convic Builders (Pty) Ltd quotation and the company was ultimately given the project to maintain DA LA2 houses in Masunga.
Plea and next appearance in court
The accused pleaded not guilty to the charge and he will appear again in court on the 22nd June 2012 as the trial continues. Mr. M Dick of DPP Francistown appeared for the state while Pheto represented himself.
