REQUIREMENTS FOR OBTAINING AND SELLING CONSUMER FIREWORKS

 

1.      In Botswana, consumer fireworks can be obtained by importing from a foreign country or by purchasing in the local market from a supplier licensed to sell fireworks in terms of the Explosives, Chapter 24:02.

 

2.      To purchase consumer fireworks within the country for private use at one’s home does not require a permit from the Department of Mines. However, a person who intends to import fireworks for private use requires having a permit to import explosives prior to such importation. 

 

3.      For selling fireworks, one will require the following permit and licence:

(a)    A permit to import and possess explosives if fireworks are imported from a foreign country or a permit to purchase, acquire and possess explosives if fireworks are  purchased locally

(b)   A licence to sell explosives

 

4.      A permit for importation of fireworks or for purchase of fireworks includes the authority of possession of fireworks too. A person holding authority to possess fireworks is known as holder and in the case of a company the holder is the managing director of the company. A holder cannot import, purchase or continue to possess fireworks after the expiry of permit for importation or purchase, as the case may be.

 

5.      A person who wants to sell fireworks has to submit to Department of Mines the following documents:

 

(a)      A duly filled application form for obtaining a permit to import and possess explosives or permit to purchase, acquire and possess explosives for fireworks, as the case may be (application form can be obtained from Department of Mines)

 

(b)      Certified copies of the certificate of incorporation issued by the Registrar of Companies and the trading licence

 

(c)      If the holder (managing director) intends to appoint a person responsible to ensure adherence to the safety requirements for handling and storing fireworks, the letter of appointment of such person signed by the holder and countersigned by the appointed person as a proof of assuming such responsibilities

 

(d)      Undertaking by the holder  or by the responsible person (if so appointed) that he will take all reasonable measures to enforce the related safety requirements (the format of document can be obtained from Department of Mines)

 

(e)      Certified copy of the identity document of the responsible person, or the holder where no other person has been appointed as responsible person

 

(f)       An original report, articulating that there is no apparent fire hazard in or around the premises where the fireworks will be stored or sold, from the fire department or in case where fire department is not available, local authority responsible for fire safety

 

(g)      A letter requesting the Chief Inspector of Explosives, Private Bag 0049, Gaborone for issuing a licence to sell explosives on the letterhead of the company giving physical addresses of the premises where the fireworks will be sold or stored
