DIVISION OF PROPERTY/DIVISION OF ESTATE (BOSWA)
1. SERVICE DESCRIPTION
This service is provided by customary courts at Headman of Record (Kgosana yo o sekisang) level involving disputes emanating from the following:
- A result of couples who have been cohabiting going their separate ways,
- The dissolution of customary contracted marriages, or
- Those that normally occur during the division of estate of parents among the siblings.
2. HOW DO I OBTAIN SERVICE?
Any aggrieved party must approach a customary court with his or her complaint. They must ideally be accompanied by their parents. A list of properties under consideration should also be provided. A customary court will issue a summons to the defendant notifying him/her about a civil suit and the date of trial. The court may undertake a tour to view any immovable property belonging to the parties.
