DIVISION OF PROPERTY
1. SERVICE DESCRIPTION
This service is provided by customary courts upon appointment by the High Court once the litigants have obtained their decree nisi, and in instances of a sour relationship of cohabitation, distribution of Boswa (inheritance).
2. HOW DO I OBTAIN SERVICE
For orders from the High Court, Customer must present themselves with an order from high court instructing a particular Customary Court to divide the property of the parties. For cases of inheritance and cohabitation, where the intervention of the court is sought, the aggrieved parties should bring their complaint to the Kgosi accompanied by their ward head and their parents, a list of the property under consideration should also be presented. Customary court will issue both concerned party with a summons for the case hearing. During the process of hearing the court undertakes a tour to view immovable property and hence conduct its assignment.
3. HOW DO I APPLY FOR THE SERVICE
- Produce the High Court order
- Come in person
- Valid Omang
- List of property
- Full particulars of the litigants
- Both parties are to accompanied by the ward headman and their parents
4. COST INVOLVED IN OBTAINING THE SERVICE
There are no costs involved
