A registration of a dispute with the Industrial Court referred by the Department of Labour following a failed mediation.
However, an applicant in the ordinary case may approach the court seeking urgent relief for his dispute.
How to request for the service
- A Certificate of Failure to settle the dispute issued to the Applicant by the Department of Labour is presented to the court registry for case registration.
- The Applicant completes a letter of referral. Letter of referral form
- The Applicant will then effect service of statement of case upon the respondent and file proof of service in the form of an affidavit with the Court. Affidavit of service form
- Upon receipt of the Applicant's statement of case by the respondent, he has to file a statement of defence within 14 working days. Applicant's statement of case form (Appendix 1)
- The respondent has to serve Applicant with his statement of defence and file proof of service with the Court. In the event that the respondent fails to respond within 14 working days the case will be set down for a default hearing. Respondent's statement of defence form (Appendix 2)
