CIVIL DEBTS
SERVICE DESCRIPTION
A case involving a civil debt below P40 000.00 is tried in the Magistrate’s Court. The plaintiff can issue summons at any Court nearest to their place of abode/residence.
HOW DO I OBTAIN SERVICE
Approach the Clerk of Court’s office or civil registry and obtain the summons and the forms.
HOW DO I APPLY FOR THE SERVICE
Fill in the forms and attach any relevant supporting documents. Submit the registration form. Serve a copy on the Defendant personally or through the Deputy Sheriff and file the return of service (proof of service).
COST INVOLVED IN OBTAINING SERVICE
• P4.00 Court fees
• Deputy Sheriff’s fees as indicated on return of service or advised.
